American doctrine of fair use, which tries to balance the interests of copyright holders with the public interest in distributing ideas and allowing others to build on them. In general, an artist or writer can copy excerpts from the works of others for the purposes of education, criticism, research or news reporting. Fair use permits a creator to use someone else's work without permission from the owner. The Lesson In software, assume that everything is already patented. You can’t build anything, no matter how new it is, without infringing someone’s patent. Of course, a very high proportion of those patents could quite likely be invalidated by prior art, from both the patent space and outside.
